Terms and conditions – Korčula Charter

General terms and conditions

1. Service Provider

Korčula Charter (hereinafter: “Service Provider”) operates as a sole proprietorship (paušalni obrt) under Croatian law and provides boat tours, private excursions, and transfers.

2. Booking and Contract

A booking is considered confirmed once the Service Provider issues confirmation and receives the required payment or deposit.
By making a booking, the Client agrees to these Terms.

3. Pricing and Payment

All prices are expressed in EUR. The Service Provider operates under the flat-rate taxation scheme (paušalni obrt) and is not subject to VAT, unless otherwise stated.
Accepted payment methods:

Credit cards (deposit via Stripe)
Bank transfer
Cash
A deposit may be required to confirm the booking.
The Service Provider does not store card details.

4. Cancellation Policy

Free cancellation with a full refund up to 7 days before the scheduled service.
Cancellations within 7 days are non-refundable.

No-show – Failure to arrive on time without prior notice is considered a no-show and no refund will be issued.
Delay – A delay of up to 15 minutes may be tolerated. After this period, the booking may be treated as a no-show.
Cancellation by Service Provider – In case of: unsafe weather conditions, technical issues, or safety concerns, the Client will be offered rescheduling (priority option) or full refund.

5. Weather and Sea Conditions

All tours are subject to weather and sea conditions. The final decision rests solely with the skipper. Sea conditions may be rough even in good weather. No refunds are granted due to subjective discomfort (e.g. waves, motion sickness).

6. Fuel Policy

Fuel is included in the price unless explicitly stated otherwise
For custom/private routes, additional fuel costs may apply and will be communicated in advance

7. Safety and Conduct

The Client must:

follow skipper instructions
behave responsibly
not be excessively under the influence of alcohol or drugs
The skipper may refuse boarding or terminate the tour without refund in case of unsafe behavior.

8. Children Policy

Children must be accompanied by an adult
Parents/guardians are fully responsible for minors
Minimum age restrictions may apply depending on conditions

9. Capacity

The number of passengers must not exceed the legally permitted capacity of the vessel.

10. Technical Issues

In case of technical failure, the Service Provider may:

provide a replacement vessel
reschedule the service
issue a partial or full refund

11. Liability

The Service Provider is not liable for:

injuries caused by failure to follow instructions
personal belongings
delays due to force majeure
Maximum liability is limited to the amount paid.

12. Force Majeure

The Service Provider is not responsible for delays or cancellations caused by events beyond control (weather, government actions, technical failures, etc.).

13. Right of Withdrawal

According to EU Directive 2011/83/EU, the right of withdrawal does not apply to leisure services scheduled for a specific date.

14. Complaints

Any complaints must be submitted in writing within 7 days after the service.

15. Photo & Marketing

Photos or videos taken during tours may be used for promotional purposes unless the Client explicitly objects.

16. Payments and Chargebacks

By completing a payment, the Client confirms acceptance of these Terms and agrees not to initiate unjustified chargebacks.

17. Data Protection

Personal data is processed in accordance with GDPR.

18. Governing Law

These Terms are governed by Croatian law. Jurisdiction: courts in Croatia.
